General Terms and Conditions
1. Scope
These General Terms and Conditions govern the relationship between Leipzig Erleben GmbH (Leipzig Erleben) and its customers. Customers are guests joining a public city tour as well as companies, tour operators, bus companies, agencies or other customers who book individual city tours. The contractual partner of Leipzig Erleben GmbH is the customer booking the service. These General Terms and Conditions apply to individual city tours including brokered services rendered by third parties as well as to public city tours.
2. Registration and Conclusion of Contract – Group Bookings
The booking of any city tour must be made in writing (by letter, fax or e-mail stating the address of the customer) to Leipzig Erleben. By making a booking, the customer accepts the General Terms and Conditions. The booking becomes legally binding as soon as Leipzig Erleben has confirmed the ordered services in writing (by letter, fax or e-mail).
If an extension of the tour is agreed upon with the tour guide, the customer must confirm in writing to the tour guide that they will bear any additional costs incurred.
3. Payment Methods – Group Bookings
Payment for the service shall be made upon receipt of the invoice without any deductions after the event or, in individual cases by prior agreement, before the service is rendered. Leipzig Erleben will charge a 10% handling fee for expenditures for catering services and/or admission fees arranged and disbursed via Leipzig Erleben. Tickets purchased through Leipzig Erleben are also subject to a 19% VAT surcharge.
4. Services, Service Changes – Group Bookings/Public Tours
The scope of the contractual services is set out in the Leipzig Erleben service description. Any additional agreements must be confirmed in writing by Leipzig Erleben. The omission of individual services does not entitle the customer to withhold the contract amount or to make a partial deduction if the reasons for this omission are beyond the control of Leipzig Erleben. If Leipzig Erleben is responsible for the cancellation of individual services, Leipzig Erleben has the right to replace these services with other services of equal value. Leipzig Erleben is obliged to inform the customer of any such changes. If necessary, the customer shall be offered a rebooking or withdrawal from the contract free of charge.
5. Right of Withdrawal
According to § 312 b para. 3 no. 6 of the German Civil Code, the right of withdrawal from the contract does not apply, as the services offered by Leipzig Erleben are to be classified as leisure activities that take place at a specific time. However, the customer may withdraw at any time under the following conditions:
6. Cancellation by the Customer, Cancellation Deadlines – Group Bookings/Public Tours
6.1 Tickets for public tours: Tours scheduled throughout the year allow guests to plan with certainty. Prior ticket reservation at tickets@leipzig-erleben.com or +49-(0)341-71 04-280 is recommended.
The public tours offered by Leipzig Erleben require the following minimum number of participants:
- Walking tours: 8 guests
- Bus tours: 15 guests
- Excursions: 25 guests
Whether or not to conduct the tour if the minimum number of participants is not reached is at the discretion of Leipzig Erleben.
Tours conducted by partner companies are subject to the terms and conditions of the respective company, which can be requested from Leipzig Erleben or viewed at the counter at the tourist information center.
If the guest has to cancel after purchasing a ticket, the ticket can be exchanged free of charge for a tour of equal value or for a voucher. If the customer does not wish to exchange their ticket(s), the following cancellation scale applies (whereby the date of receipt of the written declaration of withdrawal or the return of the ticket is used to determine the cancellation period):
- Up to 4 days before the booked tour: no cancellation fee
- Up to 1 day before the booked tour: 50% of the ticket price
- On the day of the booked tour: 100% of the price
6.2 Groups: Cancellation scale (whereby the date of receipt of the written declaration of withdrawal is used to determine the cancellation period):
Booking of tour guides:
- Up to 14 days before the booked tour: no cancellation fee
- Up to 8 days before the booked tour: 50% cancellation fee
- Up to 4 days before the booked tour: 75% cancellation fee
- Thereafter or in case of no-show: 100% cancellation fee
Bookings of more than 4 tour guides, rallies, city productions, tours with performances and/or catering:
- Up to 6 weeks before the event: no cancellation fee
- Up to 3 weeks before the event: 50% cancellation fee
- Up to 14 days before the event: 75% cancellation fee
- Thereafter or in case of no-show: 100% cancellation fee
When booking additional services that Leipzig Erleben obtains from other service providers (transportation, catering, etc.), the cancellation conditions of the respective partner companies apply. A separate fee will be charged for any rebooking (depending on the effort involved).
7. Tour Specifics – Group Bookings/Public Tours
The maximum group size for walking tours is 20 people. Routes and programs may change due to specific circumstances (e.g. construction, road closures, weather) or for organizational reasons.
A guide booked for an individual group tour is obliged to wait for 30 minutes from the confirmed start time.
If a group arrives late, a waiting fee of €20.00 will be charged if the tour is not shortened by the waiting time. If a guided tour is to be recorded, written permission must be obtained from Leipzig Erleben in advance.
8. Warranty and Liability
As the organizer, Leipzig Erleben is liable for the conscientious preparation of the event, the careful selection and monitoring of the service partners, the accuracy of the service description and the proper provision of the contractually agreed services.
Leipzig Erleben is not liable for services that are brokered as third-party services from other service providers (transportation, museum or exhibition visits, catering).
Leipzig Erleben is not liable for lost luggage or items left on the bus.
9. Data Protection
The privacy policy of Leipzig Erleben applies. It can be viewed on www.leipzig-erleben.com and in paper form at the tourist information center. In addition, these Terms and Conditions will automatically be sent by email after a user has completed the contact forms at www.leipzig-erleben.com including a reference on how to access the privacy policy.
10. Invalidity of Individual Provisions
The invalidity of individual provisions of these General Terms and Conditions or of the contract shall not result in the invalidity of the entire contract.
11. Place of Performance and Jurisdiction
The place of performance and sole place of jurisdiction is Leipzig.
